These Terms of Service ("Terms") govern your use of the services provided by Andre McCauley, LLC doing business as Cauley Leads ("Cauley Leads," "we," "us," or "our"), including the websites at cauleyleads.com and legal.cauleyleads.com, our voice communications, and our SMS messaging program. By using our services, providing consent to receive SMS messages, or otherwise engaging with Cauley Leads, you agree to these Terms. You must be at least 18 years of age to use our services or to consent to receive SMS messages from Cauley Leads. By using our services, you represent and warrant that you are at least 18 years old.
Cauley Leads is a managed customer-operations service contracted by trade contractors (including residential trades such as HVAC, plumbing, electrical, roofing, garage door, and pest control companies, and commercial trades such as mechanical, fire protection, glazing, concrete, drywall, masonry, earthwork, and general contractors) to operate their customer communication infrastructure. We send SMS messages and operate voice services as the direct provider; trade contractors are contracted service vendors of Cauley Leads.
Cauley Leads (Andre McCauley, LLC)Cauley Leads directly operates messaging and voice infrastructure to coordinate trade services for consumers and commercial customers who have requested service. We do not perform the underlying trade work. The trade service (HVAC repair, plumbing work, electrical installation, commercial subcontracting, etc.) is performed by the trade contractor you engaged. Cauley Leads handles communication: scheduling confirmations, on-route notifications, missed-call response, quote follow-up, satisfaction check-ins, review requests, and (where you have separately opted in) marketing offers about service updates and promotions.
This section governs Cauley Leads' SMS program.
Cauley Leads is the direct sender of all SMS messages under this program. Every message identifies "Cauley Leads" as the sender. The messages you can expect to receive from Cauley Leads include appointment reminders, service notifications, quote follow-ups, review requests, and marketing offers about service updates and promotions. Whether you receive marketing messages, non-marketing (transactional) messages, or both depends on which consent checkboxes you ticked on the Cauley Leads opt-in form.
You consent to receive SMS messages from Cauley Leads by submitting the opt-in form at cauleyleads.com/opt-in with the relevant consent checkbox(es) ticked, or by verbally consenting to a Cauley Leads representative reading our standard verbal consent script. The opt-in form provides two separate, optional consent checkboxes (one for marketing SMS, one for non-marketing SMS). Both are unchecked by default. Your consent is recorded in Cauley Leads' CRM with timestamp, channel, and (for web opt-in) the IP address, exact disclosure text shown, and form version.
Your consent to receive SMS messages is given specifically and exclusively for the Cauley Leads SMS program. It is not bundled into any other agreement, terms-of-service acceptance, or service contract. The two SMS consent checkboxes on the opt-in form are independent of each other and independent of any other choice or agreement on the page.
You can cancel the SMS service at any time. Just text "STOP" to (207) 517-2306. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at contact@cauleyleads.com.
Carriers are not liable for delayed or undelivered messages.

You may not copy, reproduce, distribute, or create derivative works without our prior written permission.
Cauley Leads provides communication infrastructure on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or perfectly timely message delivery, as delivery depends on third-party carriers and consumer wireless conditions. Cauley Leads does not perform the underlying trade services and is not responsible for the quality, timing, safety, or outcomes of work performed by trade businesses.
To the fullest extent permitted by law, Cauley Leads' total liability arising from or related to your use of our services shall not exceed the amount you paid Cauley Leads in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater. Cauley Leads is not liable for indirect, incidental, consequential, special, or punitive damages, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold Cauley Leads harmless from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of our services.
Either party may terminate the relationship at any time. You may opt out of SMS messages by replying STOP at any time. Cauley Leads may suspend or terminate access to its services if you violate these Terms.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. Any dispute arising from or related to these Terms shall be resolved in the state or federal courts located in Prince George's County, Maryland, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top of this page. Material changes will be communicated by SMS or email to active customers if and where required by law. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Cauley Leads regarding your use of our services and supersede any prior agreements on this subject.
